The previous edition was published in July 2011. In the intervening 11 years there have been some changes in the relevant statute law as well as the usual volume of New Zealand case law, including some significant judgments of the Court of Appeal and the Supreme Court.
One of the major changes having an impact on the conveyancing process have been the relentless progress of the computerisation of banking procedures resulting now in the banks no longer issuing bank cheques or accepting other cheques; the increase in the use of due diligence conditions which has raised issues of overlap with other terms of the agreement for sale; and significant changes to the agreement for sale and purchase form resulting in the 11th ed 2022 on which this book is based.
The fourth edition states the law as at 31 December 2021.
